Mr. Foden is in the construction advisory services sector and specializes in providing independent expert services, construction management services, quantum expert witness reports, dispute resolution, dispute avoidance, cost and claims evaluation, litigation support and arbitration proceedings.

Mark Foden has extensive industry knowledge of the construction and commercial management process, from pre-concept feasibilities through to project close out, claim preparation, dispute resolution and arbitration proceedings. Before his move to the U.S., Mr. Foden developed his career and gained his experience on complex, high profile and varied projects in the United Kingdom, Qatar, Saudi Arabia, Iraq, Tunisia, and the United Arab Emirates. He has managed and led commercial teams from project inception to the successful completion of major projects. In the last nine years, Mr. Foden has focused his skills on dispute resolution, including prolongation claims, delay events, acceleration claims, financing, loss of income and variation claims, as well as preparing rebuttals and assessments to claims received. Mr. Foden has experience in managing claims teams, contractor’s teams and owner’s teams both prior to, and during formal dispute resolution proceedings. He has knowledge and understanding of major forms of contract including FIDIC, JCT, and bespoke forms of contract, for construction projects as well as waste management contracts.
Mr. Foden has worked on both the contractor’s and the owner’s sides of the business as well as his experience in dispute resolution and arbitration proceedings. He has assisted both quantum and delay experts and has been cross examined by tribunal in DIAC arbitration proceedings for quantum works that he carried out on behalf of the party appointed expert. He has assisted in the production of expert reports on large arbitrations concerned with construction projects in the United Arab Emirates, Tunisia, and Qatar.
Mr. Foden is widely experienced in a variety of sectors including, residential, mixed-use developments, retail, education, leisure, healthcare, airports, waste management, sports stadiums, pipelines, and infrastructure.
