Mr. McCutcheon has advised on issues involving complex financial transactions, corporate governance, securities due diligence, breach of contract claims, valuation, M&A, lending, and the calculation of economic damages and business interruption insurance claims. As part of his disputes practice, Mr. McCutcheon specializes in identifying and partnering with top industry and academic experts in a variety of fields to provide expert testimony in litigation. Mr. McCutcheon works hand in glove with experts and manages teams to conduct research and analyses, draft expert reports, and assist in preparing the expert for testimony.
Mr. McCutcheon has also managed or participated in high-stakes corporate investigations of alleged financial fraud, regulatory improprieties involving non-financial disclosures, employee misconduct, and sales practices. On such matters, Mr. McCutcheon has developed targeted searches, managed large data sets, performed data analytics, reconstructed complex financial transactions, interviewed witnesses, conducted flow-of-funds analyses, and assisted his team and counsel to present findings to corporate boards and regulators.
